  1. AVG 6.0 Basic Free Edition License Agreement

  4. NOTICE:  THE FOLLOWING IS A LEGAL AGREEMENT. PLEASE READ
  5. IT CAREFULLY. INSTALLATION OR USE OF THE SOFTWARE PROVIDED WITH THIS AGREEMENT
  6. (THE "SOFTWARE") CONSTITUTES ACCEPTANCE OF THE TERMS OF THIS AGREEMENT. IF YOU
  7. DO NOT AGREE WITH ALL OF THE TERMS AND CONDITIONS OF THIS AGREEMENT, YOU MUST
  8. (i) IMMEDIATELY CEASE USING THE SOFTWARE, (ii) DESTROY ALL COPIES OF THE SAME,
  9. INCLUDING ANY COPIES STORED ON YOUR HARD DRIVE AND ANY ARCHIVAL COPIES, AND
  10. (iii) FOLLOW THE PROCEDURES ESTABLISHED BY THE MANUFACTER.

  12. LICENSE GRANT.  Grisoft, Inc. ("Grisoft") grants you a non-exclusive,
  13. non-transferable right and license to use the Software as follows:
  14.  
  15. 1. AVG Free Edition is a FREE product. There is no warranty and no technical
  16. support available unless you purchase a technical support agreement.
  17.  
  18. 2. You may install and use only one copy of the Software for single home or 
  19. office computer protection only, irrespective of the number of times you 
  20. download the Software or the number of licenses you purport to accept. 
  21.  
  22. 3. You may not use the Software on a network or more than one PC.
  23.  
  24. 4. You may make a reasonable number of back-up copies of the Software to be 
  25. used only to replace an unusable copy of the Software.
  26.  
  27. COPYRIGHT.  The Software is proprietary to Grisoft and its licensors. Grisoft 
  28. and its licensors retain all copyrights, trade secret rights, patents, 
  29. trademarks and any other proprietary rights relating to the Software.
  30. Except as expressly provided in the License Grant above, you may not copy, 
  31. reproduce, alter, modify, decompile, disassemble, reverse engineer, or create 
  32. derivative works based on, the Software. All rights not expressly granted are 
  33. reserved. Any copy of the Software which you are permitted to make under 
  34. this Agreement must include all of the copyright and other notices appearing 
  35. in the original copy of the Software.

  37. RESTRICTIONS ON TRANSFER.  This license is personal to you, and neither your 
  38. rights hereunder nor any copy of the Software, may be sold, assigned, 
  39. distributed, transferred or sublicensed to any other person, in any media 
  40. (including electronic media), without the prior written consent of Grisoft. 
  41. Any transfer in violation of this section will be null and void and will 
  42. automatically terminate your right to use or possess the Software.

  44. UPDATED VERSIONS. The Software may be updated from time to time by Grisoft 
  45. in its sole discretion. You may obtain such updated versions of the Software 
  46. from Grisoft on the terms agreed upon by Grisoft and you. Such updated 
  47. versions of the Software are expected to operate more accurately and 
  48. effectively. You acknowledge that you are responsible for downloading and 
  49. installing such updated versions of the Software.

  51. LIMITED WARRANTY. Grisoft warrants that, for sixty (60) days from the date 
  52. of delivery of the Software to you, the Software will perform substantially 
  53. in accordance with its applicable documentation. GRISOFT DOES NOT WARRANT 
  54. THAT THE SOFTWARE WILL BE UNINTERRUPTED OR THAT THE SOFTWARE WILL BE ERROR-FREE.
  55. THE ABOVE WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, WHETHER 
  56. EXPRESSED OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND 
  57. IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE. Some states do not 
  58. allow limitations on an implied warranty, so the above limitations may not 
  59. apply to you.  To the extent permissible, any implied warranties are limited 
  60. to sixty (60) days from the day of delivery to you. This warranty gives you 
  61. specific legal rights. You may have other rights which vary from state to state.
  62.  
  63. LIMITATION OF LIABILITY.  IN NO EVENT WILL GRISOFT OR ITS LICENSORS BE LIABLE 
  64. TO YOU FOR ANY CONSEQUENTIAL, INCIDENTAL OR SPECIAL DAMAGES, INCLUDING ANY LOSS 
  65. OF PROFITS, BUSINESS INTERRUPTION, OR LOSS OF DATA ARRISING OUT OF THE USE OR 
  66. INABILITY TO USE THE SOFTWARE, EVEN IF GRISOFT OR ITS LICENSORS HAVE BEEN 
  67. ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL GRISOFT'S 
  68. LIABILITY UNDER THIS AGREEMENT EXCEED THE AMOUNT OF THE LICENSE FEES ACTUALLY 
  69. PAID BY YOU IN RESPECT OF THE COPY OF SOFTWARE GIVING RISE TO THE CLAIM. 
  70. THE FOREGOING LIMITATION SHALL APPLY NOTWITHSTANDING ANY FAILURE OF ESSENTIAL 
  71. PURPOSE OF ANY LIMITED REMEDY. Some states do not allow the exclusion or 
  72. limitation of incidental, consequential or special damages, so the above 
  73. limitations may not apply to you.

  75. NOTICE TO U.S. GOVERNMENT END USERS. The Software and any accompanying
  76. documentation are provided with RESTRICTED RIGHTS. Use, duplication, or
  77. disclosure by the U.S. Government or its contractors is subject to restrictions
  78. as set forth in subparagraph (c)(1)(ii) of the Rights in Technical Data and
  79. Computer Software clause at DFARS 252.227-7013, or any successor regulation or
  80. as set forth in the particular department or agency regulations or rules which
  81. provide Grisoft or its licensors with protection equivalent to or greater than
  82. that clause.

  84. GOVERNING LAW AND GENERAL PROVISIONS.  This Agreement will be governed by the
  85. laws in force in the State of California, excluding the application of its
  86. conflicts of law principles. If any part of this Agreement is found void or
  87. unenforceable, it will not affect the validity of the balance of the Agreement,
  88. which shall remain valid and enforceable according to its terms. You agree that
  89. the Software will not be shipped, transferred or exported into any country or
  90. used in any manner prohibited by the United States Export Administration Act or
  91. any other export laws, restrictions or regulations.  This Agreement shall
  92. automatically terminate upon failure by you to comply with its terms. This
  93. Agreement may only be modified in writing signed by an authorized officer of
  94. Grisoft.
